Legal Guarantee
Products purchased by consumers are covered by the legal guarantee of conformity provided for by the Italian Consumer Code (Legislative Decree No. 206/2005, as subsequently amended).
The legal guarantee has a duration of two years from the date of delivery of the goods and covers any lack of conformity existing at the time of delivery that becomes apparent within this period.
The legal guarantee does not cover damage caused by misuse, negligence, improper installation, unauthorized modifications, accidents, normal wear and tear or use of the product in a manner inconsistent with its intended purpose.
In the event of a lack of conformity, the consumer is entitled, without additional costs, to have the product brought into conformity by repair or replacement, in accordance with the conditions established by applicable law. Where repair or replacement is impossible, disproportionate, unsuccessful or cannot be carried out within a reasonable period, the consumer may be entitled to an appropriate reduction in price or termination of the contract, where permitted by law.
Any commercial warranty offered by magneticspickups.com is additional to, and does not limit or replace, the consumer's statutory rights.
Purchases made by customers acting for purposes related to their professional, commercial, craft or business activity are not subject to the consumer legal guarantee and are governed by the applicable provisions of Italian law and by any specific commercial warranty applicable to the product.
Return of Products for Repair
To return a product for inspection or repair, please contact our offices at +39 348 2246436, Monday to Saturday from 9:00 to 13:00 and from 16:00 to 19:30, or send an email requesting return authorization to info@magneticspickups.com.
The product must be properly packaged in order to prevent damage during transport and should be returned complete with all parts and accessories relevant to the reported problem. The original packaging is recommended where available but is not a condition for exercising the consumer's statutory warranty rights.
Where the return concerns a defect covered by the legal guarantee, repair or replacement will be carried out without cost to the consumer in accordance with applicable law.
As an additional commercial service, magneticspickups.com may cover transport costs during the first 30 days from the date of purchase where the return concerns a verified warranty issue. After this period, the allocation of transport costs will be determined according to the nature of the return and the rights granted to the customer by applicable law.
Products must be returned using the shipping instructions provided when the return authorization is issued.
Right of Withdrawal
Consumers who purchase products through this website have the right to withdraw from a distance contract, without giving any reason, within 14 days in accordance with Articles 52 and following of the Italian Consumer Code.
For sales contracts, the withdrawal period expires 14 days after the day on which the consumer, or a third party other than the carrier and designated by the consumer, acquires physical possession of the goods.
In the case of multiple goods ordered in a single order and delivered separately, the withdrawal period begins on the day on which the consumer, or a third party designated by the consumer, acquires physical possession of the last item.
To exercise the right of withdrawal, the consumer must inform magneticspickups.com of the decision to withdraw from the contract by means of an unequivocal statement before the withdrawal period expires. The communication may be sent by email to info@magneticspickups.com or through the contact details indicated on the website.
The communication should contain sufficient information to identify the customer and the relevant order, including:
- Name and surname of the customer.
- Order number or purchase document number.
- Description of the products concerned.
- An unequivocal statement expressing the decision to withdraw from the contract.
The consumer is not required to provide any reason for exercising the right of withdrawal.
Return of Products Following Withdrawal
Following notification of withdrawal, the consumer must return the goods without undue delay and, in any event, no later than 14 days from the date on which the decision to withdraw was communicated.
The consumer bears the direct cost of returning the goods unless magneticspickups.com has expressly agreed to bear such costs or applicable law provides otherwise.
The goods must be properly packaged and returned with all components and accessories originally supplied. The consumer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning.
The consumer may be held responsible for any reduction in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
The absence or opening of the original packaging does not automatically exclude the right of withdrawal. However, any damage or reduction in value caused by handling exceeding what is reasonably necessary to inspect the product may result in a corresponding reduction of the refund, where permitted by law.
Refunds
In the event of a valid withdrawal, magneticspickups.com will reimburse all payments received from the consumer, including the cost of standard delivery, without undue delay and in any event no later than 14 days from the date on which magneticspickups.com is informed of the consumer's decision to withdraw.
Additional delivery costs resulting from the consumer's choice of a delivery method other than the least expensive standard delivery method offered by magneticspickups.com will not be refunded.
The refund will be made using the same means of payment used for the original transaction, unless the consumer expressly agrees otherwise, and without additional charges for the refund.
magneticspickups.com may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first.
Exclusions from the Right of Withdrawal
The right of withdrawal applies only to consumers and does not apply to purchases made for purposes related to a professional, commercial, craft or business activity.
In accordance with Article 59 of the Italian Consumer Code, the right of withdrawal is excluded in the cases provided for by law, including, where applicable:
- goods made to the consumer's specifications or clearly personalized;
- goods which, after delivery, are inseparably mixed with other items;
- sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery;
- other goods or services expressly excluded from the right of withdrawal under applicable law.
In particular, products manufactured or modified according to specific technical characteristics expressly requested by the customer may fall within the exclusion applicable to goods made to the consumer's specifications or clearly personalized.
The exclusion from the right of withdrawal for customized products does not affect the customer's legal rights in the event that the product is defective or does not conform to the agreed specifications.
